Custody
No matter what the relationship is with your children’s other parent, it is important to understand your rights with respect to child custody. Under Pennsylvania law, child custody is broken down into two parts. As a parent it is important that you understand the difference between physical custody and legal custody.  Physical custody refers to amount of time each parent spends with the child.  The parent who has 51% or more of the overnight is considered the primary physical custodian and the other parent is considered the partial physical custodian.  Legal custody refers to major decisions regarding the child such as decisions regarding the child’s medical, religious and/or educational issues.  Each custody case is unique because each family is unique.  At Rubin & Badame, we will take the time to understand your situation and to make sure that you understand what to expect from the system that will be deciding the fate of your family. Child Support

Under Pennsylvania law both parents are financially responsible for the welfare of their children. The commonwealth has enacted child support guidelines which will determine the amount of support required not withstanding certain enumerated exceptions.

Spousal Support

Similarly the state of Pennsylvania statutorily requires one spouse to financially support a dependent spouse again with certain enumerated exceptions. It is important not to confuse Spousal Support and Alimony pendente lite with Alimony, which is part of a divorce settlement. In short, once an individual is divorced they are no longer a spouse and therefore not entitled to spousal support but may be entitled to alimony.
